1. Registration; application of terms to you; your account; acceptance of agreements

Glossbird Services are the games, applications, and related services offered by Glossbird, currently including NOODS and NOODS Maker, and any other game, application, or service Glossbird has released or may release in the future (the “Glossbird Services”).

You become a user of a Glossbird Service by downloading, installing, or using it, or by completing registration of a Glossbird account where one is required. This Agreement takes effect as soon as you indicate your acceptance of these terms or otherwise begin using a Glossbird Service. You may not use the Glossbird Services if you are under the age of 13. The Glossbird Services are not intended for children under 13, and Glossbird will not knowingly collect personal information from children under the age of 13. Additional age restrictions may apply in your country, or to a particular Glossbird Service.

A. Contracting Party. For any interaction with a Glossbird Service, your contractual relationship is with Glossbird. Where a Glossbird Service is distributed through a third-party platform such as Steam, your purchase transaction may be with that platform rather than with Glossbird directly, as disclosed at the time of the transaction.

B. Content and Services. As a user, you may obtain access to certain software, content, and services made available through a Glossbird Service. This may include the Glossbird Service’s client software, updates, in-Service content, and any virtual items you may acquire (“Content and Services”). A particular Glossbird Service may impose additional terms specific to it (“Service-Specific Terms”) — for example, the Steam Workshop Content Rules applicable to NOODS Maker submissions. Service-Specific Terms, and any Rules of Use posted within a Glossbird Service, are binding on you once you indicate acceptance of them or of this Agreement, or otherwise become bound by them as described in Section 8.

C. Your Account. Where a Glossbird Service requires an account, your account may include billing information you provide for transactions. You may not reveal, share, or otherwise allow others to use your account credentials except as authorized by Glossbird. You are responsible for the confidentiality of your login and for the security of your device. Glossbird is not responsible for use of your account resulting from your disclosure of your credentials, except where that use results from Glossbird’s own fault or negligence. If you believe your account’s confidentiality may have been compromised, notify Glossbird promptly at legal@glossbird.com.

Your account, including any information pertaining to it, is strictly personal. You may not sell, charge others for the right to use, or otherwise transfer your account, nor any Content and Services associated with it, except as expressly permitted by this Agreement or by Glossbird.

D. Acceptance of Agreements. Where you place an order for Content and Services through a Glossbird Service or a third-party platform, an order confirmation acknowledges receipt of your order but does not by itself confirm acceptance; the agreement is concluded when the transaction is confirmed and the Content and Services are made available to you.

2. Licenses

A. General Content and Services License. Glossbird grants you a non-exclusive, non-transferable, revocable license to use the Content and Services of each Glossbird Service for your personal, non-commercial use, except where commercial use is expressly permitted in this Agreement or applicable Service-Specific Terms. This license ends upon termination of this Agreement or of the relevant Content and Services. Content and Services are licensed, not sold, and your license confers no title or ownership.

B. Beta / Early Access Software. Glossbird may from time to time make a Glossbird Service, or a feature of one, available before its full commercial release (“Beta Software”). You are not required to use Beta Software. Beta Software may contain bugs, may change or be removed, and may involve progress or server resets, including for Virtual Goods. Any feedback or data you provide regarding Beta Software will be treated as User Generated Content under Section 6.

C. License to Use Creator Tools. Some Glossbird Services include tools that let you create content, such as NOODS Maker (“Creator Tools”). Except as set out in any Service-Specific Terms, you may use the Creator Tools, and use, reproduce, publish, and distribute content you create with them, subject to Section 6 and any applicable content rules for that Service.

D. Ownership of Content and Services. All title, ownership, and intellectual property rights in and to the Content and Services, and all copies of them, belong to Glossbird and/or its licensors. All rights are reserved except as expressly stated in this Agreement.

E. Restrictions on Use. Except as otherwise permitted by this Agreement or applicable law, you may not copy, reproduce, publish, distribute, translate, reverse engineer, derive source code from, modify, disassemble, decompile, or create derivative works based on the Content and Services, or remove proprietary notices from them, without Glossbird’s prior written consent. You may not sell, rent, lease, or sublicense the Content and Services, or exploit them for any commercial purpose, except as expressly permitted elsewhere in this Agreement.

3. Billing, payment and virtual goods

A. Payment Authorization. Where you provide payment information to Glossbird or a payment processor, you represent that you are authorized to use the associated payment method, and you authorize the applicable charge for any Content and Services or fees incurred.

B. Virtual Goods. Certain Glossbird Services may let you purchase or otherwise obtain virtual, in-Service digital items, including NOODS Operators and other downloadable content (“Virtual Goods”). Virtual Goods have no cash value or real-world existence and generally cannot be bought, sold, gifted, transferred, or redeemed outside the relevant Glossbird Service, except where a distribution platform (such as the Steam Community Market) explicitly permits limited transfer rights. You receive a limited, non-exclusive, non-transferable, revocable license to use Virtual Goods for personal, non-commercial use in the relevant Glossbird Service; Glossbird remains the legal owner of Virtual Goods at all times, and may modify, discontinue, or revoke Virtual Goods obtained through a bug, hack, or exploit.

C. Fees and Refunds. You are responsible for applicable fees and taxes on any purchase. Purchases made through a third-party platform such as Steam are processed by that platform, and its refund policy governs those transactions. Where you have a non-waivable statutory refund or withdrawal right under the law of your country of residence, that right is not affected by this section.

D. Trading Between Users. Where a Glossbird Service or distribution platform includes a marketplace allowing users to acquire or dispose of Virtual Goods with other users, use of that marketplace is subject to the platform’s own terms in addition to this Agreement. Glossbird does not recognize transfers of Virtual Goods made outside an authorized marketplace.

4. Online conduct

You must NOT, in connection with any Glossbird Service:

i. use it for any commercial or political purpose, except as permitted under Service-Specific content or creator guidelines;

ii. copy, rent, sell, lend, sublicense, distribute, publish, or publicly display it beyond your licensed use;

iii. modify, merge, distribute, translate, reverse engineer, decompile, or attempt to obtain source code from it, except to the extent applicable law expressly permits;

iv. hack, harm, grief, harass, threaten, interfere with, or misuse it, its accounts, or other Glossbird users, community members, or staff;

v. create, use, or distribute cheats, exploits, automation software, bots, malware or scripts that interact with or affect it or other software in unauthorized ways;

vi. post commercial advertisements, promotions, spam, or unsolicited messages through it;

vii. use Glossbird’s names, logos, or trademarks for commercial purposes without permission;

viii. infringe any copyright, trademark, patent, trade secret, privacy, or other right of Glossbird or a third party through it;

ix. engage in unlawful, harassing, threatening, hateful, discriminatory, defamatory, obscene, or otherwise offensive conduct in any chat or communication feature. Glossbird reserves the right to monitor communications and restrict access to them for any reason.

Glossbird may restrict or terminate your account or access to a Glossbird Service for any conduct that is illegal or breaches this section, with or without prior notice.

5. Third-party content

Glossbird does not screen third-party content available through or linked from the Glossbird Services, and assumes no responsibility for it except to the extent required by law. Glossbird is not responsible for third-party platforms (such as Steam) through which you access a Glossbird Service, or for their availability, pricing, or policies.

Operators and other content are only official when obtained through a channel Glossbird operates or has expressly authorized, such as NOODS Maker’s submission process, the Steam Workshop, or the Operator Store. Content obtained through any other means — including direct file sharing, unofficial mod sites, or any other channel not operated or authorized by Glossbird — is not reviewed, endorsed, supported, or covered by this Agreement in any way. Glossbird has no relationship with the source of such content and disclaims all responsibility for it, including for any harm, security risk, or unlawful conduct arising from its creation or distribution. Section 6 and the content rules for a Glossbird Service govern only content submitted through official channels and do not extend to content obtained elsewhere.

6. User generated content

A. General Provisions. Some Glossbird Services provide interfaces and tools for you to generate content and make it available to other users or to Glossbird (“User Generated Content”). Except as described in the content rules applicable to a particular Service, Glossbird does not review User Generated Content before it is made available to other users, and does not guarantee that it is accurate, appropriate, or safe. Where a Glossbird Service is intended for a general, all-ages audience, that intention applies to the Service as released by Glossbird; User Generated Content is created by third parties, and Glossbird does not represent or guarantee that it will always meet that standard. By uploading User Generated Content, you grant Glossbird a worldwide, non-exclusive, sublicensable right to use, reproduce, modify, create derivative works from, distribute, and publicly display or perform that content, and derivative works of it, for the purpose of operating, distributing, and promoting the relevant Glossbird Service. This license lasts for the duration the content remains published, and, where uploaded to a third-party platform such as Steam Workshop, is granted in addition to any license required by that platform’s own terms.

You represent and warrant that you have sufficient rights in your User Generated Content to grant the licenses described above, that it was originally created by you (or, where others contributed, that you have the right to submit it on their behalf), and that your submission does not violate any applicable law or third-party right. This includes any third-party assets incorporated into your submission (for example, licensed fonts, sound effects, or asset packs): you represent that your license to that third-party material permits the use you’re making of it, including distribution through the relevant Glossbird Service and, where applicable, sale for a fee. Glossbird does not verify third-party licenses on your behalf, and you are solely responsible for confirming they cover your intended use.

B. Content Submitted Through Creator Tools. Some Glossbird Services (such as NOODS, through NOODS Maker) allow you to create User Generated Content and submit it to a store, workshop, or similar feature (“Submitted Content”). Glossbird is not obligated to accept, distribute, or continue distributing any Submitted Content, and reserves the right to remove it for any reason, including under the content rules applicable to that Service.

Submitted Content may be distributed through more than one track, which may carry different terms:

  • Paid track (for example, the NOODS Operator Store): Submitted Content made available for a fee entitles you to a revenue share of approximately 25% of the listed price, subject to standard rounding, less any fees, taxes, or chargebacks associated with the transaction. This percentage is a general benchmark and may be superseded by the specific rate stated in the separate creator agreement applicable to that Service, or in the terms presented to you at the time of submission.
  • Free track (for example, the NOODS Maker Workshop): Submitted Content made available at no cost to users generates no revenue share, regardless of its popularity or how it is later used or referenced by Glossbird or other users.

Glossbird may change the revenue share percentage, the fee structure, or which track a type of Submitted Content is eligible for, at any time and in its sole discretion. Unless the applicable creator agreement says otherwise:

  • a rate change applies only to sales occurring after the change takes effect, and does not retroactively reduce revenue share already earned on completed sales;
  • Glossbird will make reasonable efforts to post or otherwise notify creators of a material rate change in advance of it taking effect;
  • you may remove your Submitted Content at any time, though this will not affect users who already obtained a copy, or content already incorporated into a Glossbird Service;
  • Glossbird may make modifications to Submitted Content necessary for technical compatibility with the relevant Glossbird Service, without additional compensation to you.

Payout mechanics, minimum payout thresholds, and tax reporting for the paid track are handled by the applicable distribution platform (such as Steam) under that platform’s own terms, and not by this Agreement.

C. Feedback. If you provide Glossbird with feedback or suggestions about a Glossbird Service, Glossbird may use them without any obligation or compensation to you.

D. Copyright Complaints. Glossbird responds to notices of alleged copyright infringement in User Generated Content that comply with the Digital Millennium Copyright Act. If you believe your work has been copied in a way that constitutes infringement, submit a notice to Glossbird’s designated agent, the Glossbird Copyright Agent, by email at legal@glossbird.com, or by mail at 9169 W State St #715, Garden City, ID 83714 with a phone number of (415) 735-4730. Glossbird may remove or disable access to reported content and may terminate the accounts of users found to be repeat infringers.

E. Reporting Stolen Art or Other Complaints. For complaints that are not a formal DMCA notice under Section 6.D — including a report that a submission copies or traces your art or other work, a general IP concern from a member of the public, or any other issue with a specific submission — you may instead use the Operator Complaint Form at https://glossbird.notion.site/3e5c0b5235b780dea919f88c7d54d6f5?pvs=105. Glossbird reviews reports submitted this way and may remove or restrict Submitted Content at its discretion, consistent with Section 6.B and the content rules applicable to that Service, but a report through this form is not a substitute for a formal DMCA notice and does not by itself trigger the notice-and-takedown obligations described in Section 6.D. If you are the rights holder and want Glossbird’s DMCA obligations to apply, use the contact information in Section 6.D instead of the form.

7. Disclaimers; limitation of liability; no guarantees

A. Disclaimers. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOSSBIRD DISCLAIMS ANY WARRANTY FOR THE GLOSSBIRD SERVICES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE GLOSSBIRD SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITH ALL FAULTS. GLOSSBIRD IS NOT RESPONSIBLE FOR USER GENERATED CONTENT CREATED BY OTHER USERS, INCLUDING ANY OPERATOR OR OTHER SUBMITTED CONTENT YOU DOWNLOAD, SUBSCRIBE TO, OR OTHERWISE INTERACT WITH, WHICH MAY BE INACCURATE, INAPPROPRIATE, OFFENSIVE, OR OTHERWISE OBJECTIONABLE, AND YOUR INTERACTION WITH SUCH CONTENT IS AT YOUR OWN RISK.

B. Limitation of Liability. TO THE MAXIMUM EXTENT PERMITTED BY LAW, GLOSSBIRD WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE RESULTING FROM THE USE OR INABILITY TO USE THE GLOSSBIRD SERVICES, INCLUDING INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, EVEN IF GLOSSBIRD HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL GLOSSBIRD’S TOTAL LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE GLOSSBIRD SERVICES EXCEED ONE THOUSAND UNITED STATES DOLLARS ($1,000.00 USD). THE EXCLUSIONS AND LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN GLOSSBIRD AND YOU.

C. No Guarantees. GLOSSBIRD DOES NOT GUARANTEE CONTINUOUS, ERROR-FREE, OR SECURE OPERATION OF THE GLOSSBIRD SERVICES.

D. Non-Waivable Rights. Nothing in this section excludes or limits any liability, or any consumer guarantee, right, or remedy, that cannot be excluded or limited under applicable law, including statutory rights available to residents of the EU, UK, Australia, or elsewhere.

8. Amendments to this Agreement

A. Mutual Amendment. This Agreement may be amended at any time by your explicit consent to changes proposed by Glossbird.

B. Unilateral Amendment. Glossbird may otherwise amend this Agreement (including Service-Specific Terms) at any time in its discretion. Glossbird will give notice of any material amendment by posting the updated Agreement, with a revised “Last updated” date, on Glossbird’s website or within the affected Glossbird Service, at least 30 days before it takes effect. Your continued use of the affected Glossbird Service after that date constitutes acceptance of the amendment. If you do not agree, your remedy is to stop using the affected Glossbird Service.

9. Term and termination

A. Term. This Agreement takes effect when you first indicate acceptance of it, or first use a Glossbird Service, and continues until terminated as set out below.

B. Termination by You. You may stop using a Glossbird Service, or request that Glossbird terminate your account, at any time. Termination does not entitle you to a refund of fees already incurred, except as required by law or a distribution platform’s own refund policy.

C. Termination by Glossbird. Glossbird may restrict or terminate your account or access to a Glossbird Service if (a) Glossbird ceases offering that Service generally, or (b) you breach this Agreement or applicable Service-Specific Terms. Where termination results from your breach, no refund will be provided, except as required by law.

D. Survival. Sections 1.C, 1.D, 2.D, 2.E, 3, and 5 through 12 survive any termination of this Agreement.

10. Class action and jury trial waiver (U.S. users)

THIS SECTION APPLIES ONLY TO USERS IN THE UNITED STATES, OR USERS WITH A DISPUTE AGAINST GLOSSBIRD ARISING UNDER U.S. LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND GLOSSBIRD EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND TO PARTICIPATE AS A PLAINTIFF, CLAIMANT, OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING AGAINST THE OTHER. ANY DISPUTE BETWEEN YOU AND GLOSSBIRD MUST BE BROUGHT IN YOUR OR OUR INDIVIDUAL CAPACITY ONLY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING, UNLESS BOTH PARTIES AGREE OTHERWISE IN WRITING.

Disputes remain subject to the ordinary courts identified in Section 11; this section does not require arbitration. If this waiver is found unenforceable as to a particular dispute, that dispute may proceed on a class, collective, or representative basis only in the courts identified in Section 11, and the remainder of this Agreement remains in effect. This Section 10 survives termination of this Agreement.

11. Applicable law / jurisdiction

For users outside the European Union and United Kingdom: This Agreement is governed by the laws of the State of Delaware, without regard to conflict-of-law principles, consistent with Glossbird’s state of incorporation. Subject to Section 10, disputes arising out of or relating to this Agreement or your use of a Glossbird Service will be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of those courts.

For EU and UK users: This Agreement is governed by the law of the country where you have your habitual residence, and this section does not affect any non-waivable consumer protections available to you under that law.

12. Miscellaneous

If any provision of this Agreement is held invalid or unenforceable, that provision will be deemed severable and the remainder will remain in effect. This Agreement, together with any Service-Specific Terms, constitutes the entire agreement between you and Glossbird regarding its subject matter, and does not confer rights on anyone other than you and Glossbird. Glossbird’s obligations are subject to applicable law and legal process, and Glossbird may comply with law enforcement or regulatory requests notwithstanding any contrary term. You agree to comply with applicable import/export laws and represent that you are not located in, or a resident of, any country subject to relevant trade sanctions.

This Agreement was last updated on October 8th, 2026.
